These sound a bit harsh but we have to have them in case we get bad tenants...... (not you of course!)
GENERAL CONDITIONS OF RENTAL 2020 LUVITERE (Monsieur Andrew Robinson) SIRET 433 373 057 00010
Contracts issued by LUVITERE (owner: Mr. Andrew Robinson) are in the name of the main tenant that will take full responsibility of the leased property; the full names of each future occupant with their ages must be listed on the rental commitment. No contract may be assigned or transferred without the consent of the owner. In all cases, the payment of the deposit implies acceptance without restriction of the general conditions in force and valid reservation.
PRICE :They include: the provision of housing for the duration specified in the contract + water, electricity, wood for the fireplace, fuel for the petrol heaters (where such services are available), use of Port Venus Village's own services (parking, pool - approx open mid-May to mid-September.) + using our reception on arrival and departure, as well as our technical service and support during the stay (except Sundays and holidays). Bed- and bathroom linen is provided for 4 persons. Our prices do not include the following services: foreign transfer fees for payments sent from outside the euro zone (if deducted by French banks), cleaning during your stay and departure, security deposits; "Cancellation-civil liability and miscellaneous risk" insurance (SEE « INSURANCE » BELOW); municipal tourist tax and the entrance card to the naturist resort of Cap d'Agde (according to current rates).
BOOKING :No reservations will be accepted without payment of 25% of the rental amount as deposit, the balance must be paid no later than 30 days before handing over the keys. When the reservation is made 30 days or less before handing over the keys, 100% of the rental amount is due. In case of failings by the person reserving, the paid deposit amount will be retained.
CANCELLATION: Should there be a cancellation + 45 days before arrival: administration fees and the deposit will be kept by the owner; between the 44th and the 30th day preceding the entry into the property = 50% of the contractual rent is due. Between the 29th and the day of arrival = 100% of the contractual rent is due. Any commenced rental period is entirely due and can not be refunded in case of interruption or early departure.
INSURANCE: When booking, we advise you to take out Holiday Insurance for « Cancellation, Civil Liability and Other Risks". Otherwise, THE PRICE OF THE RENTAL INCLUDES CIVIL LIABILITY INSURANCE only, which covers the renter and the people mentioned on the rental contract.
ARRIVAL: Start of the rental on Friday, Saturday or Sunday between 6:00 p.m. 4:00 p.m. (sometimes cleaning or repairs in progress). Late arrivals: In case of delay or delayed arrival, the tenant must phone the owner before 5:30 p.m.. Should there be no news from the tenant, with 24 hours having elapsed, the owner considers that there is breach of contract by the tenant, with all the resulting consequences and the owner can re-let the accommodation without compensation or refund.
DEPARTURE : End of rental: DEPARTURE mandatory before 12 am, should the tenant leave at night (before 8 am), the keys should be returned by placing them in the owner's letter box. For any delay, an extra 50 € will be automatically deducted from the security deposit. The accommodation must always be returned under the following conditions: dishes etc. clean and put away, indoor and outdoor furniture left in their original place, bed covers in place, house linens made clean (sofa cover, bed, mattress covers, curtains ..) used sheets and used pillowcases removed and folded, empty fridge and freezer, and bins emptied and taken out. Otherwise putting the accommodation back in order will be charged 50 € / hour + any laundry charges, and all will be automatically deducted from the deposit.
CLEANING: The cost of « LIGHT CLEANING AFTER MY STAY » (60€) is added to the price at the time of reservation, and paid for before or on arrival – this assumes that the property will be given back in good condition with everything put away. Any complaint regarding the cleanliness of the accommodation on arrival must be filed on the day of arrival before 19h. After this time any claims or demands for intervention of our cleaning staff will not be taken into account. When you do your quick clean yourself for departure, be sure to check on the following: floors (broom, vacuum, mop), windows, kitchen (stove, worktop, large and small appliances, ...), bathroom, WC ...
SECURITY DEPOSITS: These are an essential guarantee for the owner: the security deposits are mandatory. To save you valuable time on arrival you can contact us when paying the balance of your rental payment, with the card you wish to use for your security deposits. Otherwise it will be required on arrival against the keys. SECURITY DEPOSITS are accepted only by VISA or MASTERCARD. Apartment deposit (Incl. deposit of 2nd set of keys if requested) : Luvitere , 29/30 Port Venus Village: 900 €. This amount includes the deposit for WI-FI: Orange wifi box : the main tenant in the contract will be solely responsible for all websites visited and downloads for the duration of the stay. Additional cleaning deposit - 100 €. You have already paid the sum of 60 € for "light cleaning after my stay" of Villa Luvitere after departure. If the condition of the apartment requires more than one hour of cleaning, it will be deducted from the cleaning deposit. Cash and cheques are not accepted. The security deposit card imprints are destroyed within 8 days of your departure after inventory and checking the apartment's condition. Should the contents or condition not be correct, we will complete the necessary cleaning and repairs and debit the corresponding amounts automatically from your deposit. The invoice will then be sent.
INVENTORY / CONDITION OF THE PROPERTY: The inventory list given on arrival must be returned to the owner the day after, duly signed by the tenant, with indication of the missing objects in relation to the inventory available in the property, and reporting of damaged or defective equipment. Outside this period, the owner will consider that there is nothing to report. Thus, any failure or damage which will come to be known later, will be systematically deducted from the tenant's security deposit. You can choose the time of the departure inventory check on your arrival (between 10 and 11). Due to difficulties in season to obtain the intervention of a specialized company (external service providers) such interventions need to take place, in the company of the owner, at any time, excluding Sundays and holidays. The owner disclaims all liability as to time for completion of repairs, or for lack of access to the pool, for example. The tenant can not claim any compensation or rent reduction if urgent repairs appear during the time of the lease. Similarly, should essential items be missing from the inventory on arrival, the tenant can ask for these from the owner, who will provide replacements from available stock and in the shortest possible time.
OCCUPATION OF THE PROPERTY AND CAPACITY: The Owner reserves the right to terminate the contract without compensation if one or more occupants are not those originally specified in the contract. The tenant, and the other occupants mentioned on the rental commitment, will enjoy unrestricted housing and facilities of the residence (swimming pool, etc ..) Each residence has its own opening and closing dates of such equipment.: the owner cannot be held responsible in case of technical problems preventing the use of said equipment. The behaviour of the tenant (and other occupants and their visitors) must be peaceful and courteous; everyone must take care of the property. In all cases where they exist, the tenant will comply with the rules of the residence where he is staying. The accommodation can not be occupied by a number of people exceeding its capacity on the contract. The number of people, the name, first name and date of birth must be specified when booking; in any event, a reminder that the capacity of Luvitere is 4 people. The owner will have the possibility to terminate the contract 24 hours after a formal notice to the tenant: 1) If the property is occupied by a number of people higher than that on the contract 2) If the occupants are the subject of neighbourhood complaints about noise or failure to comply with residence regulations or for any damage to common or private areas. 3) If the tenant receives more than SIX guests on the premises for any reason (limit of 4 occupants + 6 guests on site) - these guests will not spend the night 4) If during the stay, housing is not maintained in a correct state of inner and outer cleanliness. The payment of a rental deposit implicitly confirms the fact that the principal renter has already read, understood, and accepted the above conditions, with or without signature of this document.
